Constructive dismissal is the term used for a situation when an employee terminates their employment with their employer due to a sufficiently serious breach of their terms of employment.
It can be as a result of bullying, harassment, discrimination, a breach of contract, a change to pay or status without mutual agreement and/or other conduct that materially affects the working relationship between the employee and employer etc.
People often think of the term “constructive dismissal” as its own reason for bringing a case. Constructive dismissal is however, a branch of unfair dismissal.
